PROCEDURE FOR ARCHITECTURAL CHANGES

EACH AND EVERY HOMEOWNER IS REQUIRED TO MEET THE REQUIREMENTS OF THE DECLARATION OF COVENANTS, CONDITIONS, AND RESTRICTIONS, AND THE BY-LAWS FOR CHESTNUT WOODS CONDOMINIUM ASSOCIATION. UNIFORMITY OF ARCHITECTURE AND LANDSCAPING CONTRIBUTES TO THE ATTRACTIVENESS OF THE COMMUNITY AND HELPS TO MAINTAIN PROPERTY VALUES.
IN ORDER TO MAINTAIN THESE STANDARDS AND HAVE THEM APPLIED UNIFORMLY, THE BY-LAWS FOR THE CONDOMINIUM, ARTICLE XI. GIVE THE ABILITY TO HAVE AN ARCHITECTURAL CONTROL (AAA) COMMITTEE (SECTION 1.). SEE COPY OF ARTICLE XI IN ITS ENTIRETY AT THE END OF THIS PROCEDURE FOR REFERENCE.
THE ROLE OF THE ARCHITECTURAL CONTROL COMMITTEE (ACC) IS TO MAKE SURE THAT THE RULES OF ARTICLE XI ARE COMPLIED WITH WHEN HOMEOWNERS DESIRE ANY ALTERATIONS OR CHANGES TO ANY UNIT OR TO THE GENERAL OR LIMITED COMMON ELEMENTS OF THE CONDOMINIUM ASSOCIATION.
REQUIREMENTS
BEFORE STATING THE STEPS OF THE PROCEDURE THERE ARE THREE (3) VERY IMPORTANT REQUIREMENTS EVERYONE NEEDS TO KNOW:
1) NO REQUEST BY ANY HOMEOWNER WILL BE GIVEN A "VERBAL AUTHORIZATION" BY ANY ONE (1) BOARD MEMBER. THE REQUEST MUST BE REVIEWED BY THE ENTIRE BOARD.
2) NO REQUEST WILL BE GIVEN AN "IMMEDIATE" AUTHORIZATION". EVERY HOMEOWNER MUST FOLLOW THE PROPER PROCEDURE. THIS PROCEDURE MIGHT TAKE UP TO, BUT NO LONGER, THAN 45 DAYS SINCE THE BOARD ONLY MEETS ONCE A MONTH.
3) NO WORK IS TO BE STARTED BEFORE WRITTEN AUTHORIZATION BY THE BOARD IS GIVEN.
THEREFORE, ALL HOMEOWNERS MUST PLAN THEIR PROJECT TIME ACCORDINGLY. NO REQUESTS WILL BE APPROVED IMMEDIATELY IN ORDER TO ACCOMMODATE A CONTRACTOR'S SCHEDULING TIME. NO EXCEPTIONS TO THIS RULE WILL BE TOLERATED.
SAM FORM (STANDARD ARCHITECTURAL FORM)
TO FACILITATE THE HANDLING OF CHANGE REQUESTS BY THE ACC AND TO REDUCE MISUNDERSTANDINGS AND DELAYS THAT ARISE WHEN INADEQUATE INFORMATION IS PRESENTED, THE "SAM" FORM WAS DESIGNED. A COPY OF THE FORM FOLLOWS THIS SECTION. THESE FORMS ARE AVAILABLE FROM ANY BOARD MEMBER AND FROM THE MANAGEMENT, TRENTON PROPERTY SERVICES, INC.
STEPS FOR CHANGE
1) COMPLETE A "SAM" FORM INCLUDING PLANS AND SPECIFICATIONS SHOWING LOCATION, NATURE, SHAPE, SIZE, HEIGHT, MATERIAL, COLOR, AND TYPE OF CONSTRUCTION.
2) COPY OF PERMIT IF PERMITS ARE REQUIRED BY BALTIMORE COUNTY (I.E. FOR FENCE, ETC.)
3) COPY OF LOCATION SURVEY OR SKETCH OF PROPERTY SHOWING LOCATION OF CHANGE INCLUDING DIMENSIONS AND SETBACKS
4) MAIL COMPLETED FORM TO TRENTON PROPERTY SERVICES, INC. OR GIVE TO THE CHAIRMAN OF THE ACC.
5) REQUESTS WILL BE INVESTIGATED BY A MEMBER OF THE ACC PRIOR TO THE NEXT BOARD MEETING. HIS FINDINGS WILL THEN BE BROUGHT BEFORE THE ENTIRE BOARD FOR REVIEW AT THAT NEXT METING. THE ENTIRE BOARD WILL THEN VOTE TO EITHER:
A) ACCEPT
B) ACCEPT WITH CONDITIONS
C) DECLINE
THE REQUEST.
6) THE DECISION OF THE BOARD WILL BE SENT TO THE HOMEOWNER IN WRITING.
7) ABSOLUTELY NO WORK IS TO BE STARTED BEFORE APPROVAL BY THE BOARD IS GIVEN
8) ANY CHANGES THAT HAVE NOT BEEN APPROVED BY ACC AND THE BOARD ARE SUBJECT TO IMMEDIATE REMOVAL.
9) WORK MUST BE COMPLETED WITHIN 90 DAYS OR THE ARCHITECTURAL CHANGE REQUEST WILL HAVE TO BE RESUBMITTED.
IF THE REQUEST IS "ACCEPTED WITH CONDITIONS", THE HOMEOWNER MUST COMPLY WITH EXACTLY ALL CONDITIONS OR THE REQUEST IS NULL AND VOID.
IF THE REQUEST IS "DECLINED", A HOMEOWNER CAN APPEAL WITHIN 30 DAYS, CONTINGENT ON DOCUMENTED PROOF OF APPROVAL FROM BOTH IMMEDIATE NEIGHBORS.
