POOL RULES & REGULATIONS

2005 SEASON

 

POOL SCHEDULE: (Section I)

1. The Board of Directors will determine each year the opening and closing dates for the pool season.

2. The hours that the pool will be opened are:

POOL ENTRY RULES: (Section II)

1. No one may enter the pool when the pool is closed, except authorized personnel.

2. The lifeguard must be on duty and the pool officially open before any user is allowed in the water or pool area.

3. All persons using the pool or pool area do so at their own risk and take sole responsibility. The management does not assume responsibility for any accident or injury in connection with such use.

4. The patrons agree to save harmless the management and/or association from any and all liabilities and action of whatsoever nature by any guests growing out of the use of the swimming pool or pool area.

5. No one may enter the pool when the lifeguard is not present at his/her station. Whenever the lifeguard must leave his/her station, everyone must vacate the pool.

6. Residents must bring pool pass with them when entering pool. Residents must pick up pass when exiting pool. Any passes left at pool will be confiscated. Everyone is responsible for his or her own passes.

7. Residents and guests must also sign-in upon entering the pool facility. Your cooperation in presenting ID cards and signing-in helps the pool management company keep accurate records on pool usage. This ensures adequate lifeguard coverage now and in the future.

8. Homeowners are responsible for getting pool passes for their rental residents.

9. Residents 5 years of age and over must have a pool pass.

10. The condominium fee of the Resident's unit must be paid to date when the pool opens to receive a pool pass. The Board of Directors reserves the right to revoke any pool passes of residents of units whose condominium fee becomes delinquent.

11. Children 12 years and UNDER must be accompanied by a parent or adult guardian at all times.

12. Children 12 years of age and OVER may not enter or stay in the pool area unless they:

a. Pass a swim test of abilities given by the managing lifeguard, which

Must be renewed each year -- OR --

b. Are in the presence of an adult resident 21 years of age or older.

13. Guests may enter the pool and pool area, provided they have a valid guest pass and are accompanied by an adult resident, age 21 and over. The Board of Directors reserves the right to restrict the number of guests to 2 passes per day. When a resident leaves, the guest must also leave.

14. Due to lack of parking facilities by the pool, parking is prohibited except for:

a. Homeowners in the immediate area

b. Lifeguards and their management

c. Authorized personnel

LIFEGUARD'S RIGHTS, RESPONSIBILITIES AND AUTHORITY: (Section III)

1. The single responsibility of a solo lifeguard is to watch swimmers when the pool is occupied.

2. The pool may be closed at any time due to mechanical breakdown, operational difficulties, or inclement weather. The decision is at the sole discretion of management.

3. The managing lifeguard will issue a swimming test to children from 12-16 years of age. The swimming test will have to be renewed on a yearly basis.

4. The lifeguard may require a doctor's certificate and/or refuse entry to the pool area of persons having a skin disease, sore or inflamed eyes, a cold, nasal or ear discharge, excessive sunburn, open sores or bandages, or a communicable disease.

5. The lifeguards will deny admission to the pool area to any person who, in his/her opinion is intoxicated.

6. The lifeguard has the authority to limit the number of persons using the pool at any time when in their opinion the number presents an unsafe condition.

7. The lifeguards may control the use of beach balls, surf mats, rafts, inner tubes, etc., if they deem conditions are unsafe. Stacking of inner tubes is prohibited.

8. The lifeguard has the authority to correct any unsafe condition created by any person or persons. Anyone responsible for creating these conditions may be expelled from the pool/pool area until a hearing with the Board of Directors and Pool Committee can be arranged. At the hearing the lifeguard will be required to explain his/her action and the Board will decide if any further action is required.

9. The lifeguards have the responsibility to enforce these rules and suspend anyone who violates them. Suspension by the lifeguards may not exceed 7 days. The interpretation of these rules by the lifeguard and their decision is final.

10. Anyone who vehemently opposes the lifeguard's decision may bring his/her grievance before the Board of Directors and the Pool Committee.

GENERAL RULES: (Section IV)

1. No glass is allowed in any portion of the pool area.

2. No sunflower seeds or shelled nuts permitted at the pool or pool area.

3. Only persons wearing swimsuits may enter the pool. Bathing caps must be worn at the discretion of the lifeguard.

4. For artificial flotation purposes, the only item which may be used, is a US Coast Guard approved life vest. If a child utilizes this item, an adult must still accompany the child in the main pool.

5. Wading Pool Rule: The wading pool is restricted to use by children 6 years of age and younger under the direct supervision of a parent or adult guardian. The parent or adult guardian must remain in the wading pool area with the child at all times. Children over the age of 6 are not permitted to use the wading pool. Any children using the wading pool and who are not toilet-trained must wear tight fitting rubber pants or "swim diapers".

6. Wading Pool Rule: No diving in the wading pool is permitted at any time.

7. In the event of fecal contamination in either the main or wading pool, the pool will be closed for 12-48 hours in accordance with Baltimore County Health Department regulations.

8. No urinating in main or wading pool.

9. Any child or infant who is not "toilet-trained" will not be permitted in the main pool at any time.

10. No diving in the shallow end of the adult pool. Diving is restricted to the "diving section" of the pool only. Individuals choosing to dive do so at their own risk.

11. Picnic tables are restricted for use for food consumption only. No sitting on top of the table.

12. A 10-15 minute adult swim may be called at any time at the discretion of the lifeguard.

13. Residents will be held responsible for all actions of their guests.

14. The cost of any property damage will be charged to the responsible party.

15. Management will not be responsible for loss or damage to any personal property of any kind.

16. Running, pushing, wrestling, ball playing, or causing undue disturbance in or about the pool area will not be tolerated. Spouting of water and similar non-hygienic acts will not be permitted in the pool.

17. Abusive or profane language or breach of the peace will not be tolerated.

18. All persons use this facility at their own risk and in conformance with all rules and regulations. Individuals may be barred from the pool or pool area, at the discretion of the lifeguard in charge, for violation of said rules or for any other reason which in his/her judgment constitutes a hazard to others or to the management, the lifeguard is responsible for the strict enforcement of those rules and has authorization to temporarily deprive any member or guest of use of pool/pool area. A written statement is to be filed with management and sent to the Board President within 24 hours if such action is taken.

19. All radios must be kept at a low volume.

20. Pets or animals of any kind; bicycles; motorbikes; and skateboards are not permitted in the pool area at any time. Baby strollers and baby carriages are not permitted within ten (10) feet of the pool.

21. Chewing gum is not permitted in the pool area at any time.

22. All beverages or food brought into the pool area must be in paper or plastic containers and are to be consumed in designated areas. All trash must be disposed of in a trash container. Glass containers (i.e. baby food jars, drink bottles, etc.) are not permitted in the pool area.

23. Only one person is permitted on the diving board at a time. The individual on the diving board may bounce only one time on the end of the diving board and must go straight off the diving board. Flips and back dives are strictly prohibited. No diving or jumping off the diving board from a backwards position. The "diving well" must be clear of other swimmers before anyone can go off the diving board.

24. All personal injuries, however slight, must be reported to the lifeguard on duty.

25. No grill or cooking is permitted inside the pool area during normal operational hours. Cooking is only permitted if the pool is reserved for a private pool party.

26. No private pool parties are to be held unless the pool area is rented. The pool and its surrounding area are considered "Common Area" and cannot be restricted by an owner during normal operating hours.

27. Chairs, tables, and chaise lounges cannot be reserved. These items are on a "first come - first serve" basis.

POOL PARTIES: (Section V)

1. Private pool parties will be scheduled between 8:00 p.m. and midnight on those nights the pool closes at 8:00 p.m.

2. Any residents wishing to rent the pool for a private party must sign a written contract and make all arrangements with the "Pool Committee Chairman" or "The President" of the Association. A rental fee of $100 along with a clean-up fee of $100 is required when reserving the pool. The $100 clean-up fee may be refunded contingent upon the following:

a. Only after the check for the rental fee clears the bank will the clean-up fee be returned if no damages are incurred.

b. When an inspection of the pool area is completed and is left in a clean and safe condition. The inspection of the pool area will be made before noon on the day following the party.

c. Should any check be returned for 'non-sufficient' funds (NSF), the Board reserves the right to suspend pool privileges for a time period to be determined by the Board. A $25 processing charge will be added to the account of the resident.

3. Persons making arrangements for a party must also arrange for an approved lifeguard to be present at the pool party. The cost of the lifeguard is not included in the fee or deposit for the usage of the pool and must be arranged separately with the lifeguard.

4. An estimate of the number of guests should be furnished when arrangements are made for the party.

5. Persons making arrangements for a party must clean up the pool area before noon of the following day or forfeit all monies deposited.

6. Persons making arrangements for a party are responsible for the conduct of all guests and ensuring these pool rules are not violated.

7. Food and grills are allowed at pool parties but must be away from pool area. All beverages, both alcoholic and non-alcoholic are allowed but only in unbreakable containers.

8. All guests attending private pool parties shall not park near the pool area. Non-homeowner guests should park on Transverse Avenue and walk to the pool.

VIOLATIONS: (Section VI)

1. The disciplinary action that will be taken when these rules are violated are:

a) 1st Offense-Verbal warning, unless it constitutes a health hazard, then it will be up to the discretion of the lifeguard as stated in Section III, Rule 8 of these Pool Rules and Regulations.

b) 2nd Offense-3 swim days suspension

c) 3rd Offense-7 swim days suspension

d) 4th Offense-all pool privileges revoked for the remainder of the season.

2. Refusal by anyone to leave the pool when requested and/or causing a disturbance will result in one or all of the following:

a) The calling of the Baltimore County Police to assist with removing the person causing the trouble.

b) The pressing of charges for trespassing on private property, or;

c) Revoking all pool privileges for the remainder of the pool season from the homeowner involved or the homeowner who is responsible for the guest involved.
